
Hi, I’m Sherry and I work for Lavin Law Group. I am the probate paralegal for attorney Christopher Lavin and I’m here to talk to you a little bit about probate. Some of the common misconceptions with avoiding probate is that if you’re married and you have both people on the deed that it will avoid probate.
And unless you have with right of survivorship or to the survivor of them, it will have to go through probate. So if it is just in the name of a married couple as individuals, if one person does pass away, unfortunately, there will be a need for probate. Another misconception is on a vehicle.
A lot of people miss that. You are able to put a transfer on debt on your vehicle title. You can do that at the title office.
And being able to avoid probate is really just being able to add beneficiaries to all of your assets, your checking, your savings, your money markets, your stocks, your bonds, your 401ks, any assets like that. So as long as you have beneficiaries listed on those assets, you can avoid probate. However, if you find yourself in a situation that you do need assistance with probate, please contact us.
