Hi, I’m Sherry Gatrell with Lavin Law Group. I’m a paralegal here helping Mr. Lavin with all of the probate that he has.
We often get asked: if you do have a trust, do you still need to have a will? The simplest answer is yes. It helps to facilitate the probate process if there are things that are not in your trust and there are no beneficiaries listed. These assets typically do have to go through probate in order to be able to get those to the family or to a named beneficiary individual.
